The Madhya Pradesh Government will be filing a Special Leave Petition (SLP) before the Supreme Court against the Madhya Pradesh High Court Stay Order on providing 27% reservation to Other Backward Classes (OBC) aspirants in the Civil Services examination conducted by Madhya Pradesh Public Service Commission (MPPSC).
On February 16, 2022; a Division Bench of the High Court directed General Administration Department (GAD) to make sure that the OBC category reservation does not exceed 14% while declaring the results of MPPSC State Services exam in 2019.
On September 9, 2022; all the departments were asked by the State government to implement enhanced 27% reservation for OBCs in all departments except recruitment in Health, Medical Education, and Education departments. However, the High Court put a Stay on it.
Advocate General Prashant Singh for the State said that the Orders issued by GAD on providing 27% reservation to OBCs were put on an Interim Stay by the High Court.
He stated that an SLP will be filed in the Supreme Court will the State government’s consent. He added that a request for an early hearing of the Case will be made.
The recruitment process is hindered due to the Petition of OBC reservation pending before the Court. The Petitions with respect to OBC reservation have been pending before the High court for 3 years.
Advocate Aditya Sanghi, who is one of the Petitioners stated that though a Stay was put on enhanced OBC reservation by the High Court, the State Government enacted the increased reservation of OBCs.
He added that the Order was misinterpreted by the State Government due to which the results of every recruitment exam are being put on Stay by the Court.
The OBC reservation of 27% was applied as per an Ordinance passed in March 2019. The Ordinance became law in August 2019.
