A Special National Investigation Agency (NIA) Court rejected a Medical Bail Application filed by Shoma Sen, a former Nagpur University Professor who was arrested in the Bhima Koregaon-Elgar Parishad caste Violence Case in 2018.
A Special Judge DE Kothalikar stated, “The Prison Authority shall observe Medical protocol and provide appropriate Medical aid to the Applicant (Sen) if required.”
Sen claimed in her application, through Advocates Sharif Shaikh and Kritika Agarwal that she suffered from hypertension, high blood pressure, and other health issues, making her vulnerable to the Covid-19 virus.
Sen further insisted on Guidelines issued by the High Power Committee (HPC) to release certain people due to the Covid-19 pandemic.
Special Public Prosecutor Prakash Shetty opposed the Application, stating, “The similar pleas filed by other accused have been rejected. Moreover, Covid-19 can not be used as a ground for release anymore.”
Shaikh, on the other hand, claimed that the Guidelines issued by HPC are still in effect, therefore they are entitled to claim appropriate reliefs.
However, the Special Court rejected the Bail Application.
