The Sessions Court rapped the State Crime Investigation Department (CID) and the State Government of Maharashtra for their careless approach in appointing a Special Public Prosecutor for the Trial in the Khwaja Yunus Custodial death case.
The Court observed, “The approach of the Investigating agency has been lackadaisical in such serious offences like custodial death cases.”
The Accused in the case includes dismissed Indian Police Officer Sachin Waze and three other Constables, who were reinstated by the Mumbai Police last year.
The Additional Sessions Judge Dr U.J More s, “As I have observed on past two dates, there is a delay at the instance of the Prosecution to proceed with the case. The record reveals that despite repeated notices and letters to the Police Officers as well as the Prosecution, no concrete steps are taken.”
Deputy Superintendent of Police (SP) Irfan shaikh from State CID informed the Court that the appointment has been approved by the Additional Chief Secretary, Home. The file is now pending with the Law and Judiciary Department.
Advocate Chetan Mali, who represented Asiya Begum mother of the Victim Khwaja Yunus informed the Court that a Petition regarding the removal of Dhiraj Mirajkar as the Special Public Prosecutor of the case is pending before the Bombay High Court.
The State through its Assistant Public Prosecutor has made a statement in the High Court, that it will not appoint anybody for the said post in the case till the Petition is decided in the Bombay High Court. Advocate Chetan Mali claimed that the State won’t appoint any Special Public Prosecutor as they want Dhiraj Mirajkar to continue to be on the post.
The Court has further asked the Victim’s mother to file a status report about the pending matter and also asked the State CID to appoint the Special Public Prosecutor by the next date.
