The National Investigation Agency (NIA) opposed PV Varavara Rao’s petition seeking extension of his medical Bail.
The Agency stated that the Court cannot extend the Bail if the reports do not state any major medical illness which makes it necessary to increase the Bail or provide the option of House Arrest.
Varavara Rao was accused in the Bhima Koregaon – Elgar Parishad Case.
Rao along with 14 other activists were accused for furthering the banned CP Maoist’s agenda and conspiring to demolish the Government. They were booked under the Unlawful Activities Prevention Act (UAPA) based on emails and letters acquired from electronic devices.
Varavara Rao was granted medical Bail on 22nd February under the strict condition of not leaving Mumbai as he suffers from several neurological conditions and also age-related ailments.
Rao now pleaded an extension of his medical Bail before the Court and also that the condition of not leaving Mumbai be removed.
The accused pleaded relief because if he is sent back to Custody his conditions will deteriorate and be the same as earlier when he had to be admitted to JJ Hospital three times before being granted medical Bail and getting transferred to Nanavati.
Apart from his neurological issues the accused also suffers from Lacunar Infarcts commonly known as dead brain tissue due to arterial blockages in a small part of the brain which deals with memory and visual processing.
Rao also suffers from cataract in both his eyes and have been strongly recommended surgery for the same.
A Division Bench comprising Justices SS Shinde and NJ Jamadar adjourned the hearing to Rao’s plea to 24th September and also moved forward his date of surrender to 25th September.
