The Lucknow Bench of Allahabad High Court has halted the eviction of a deserted old couple from an old-age home, making it a landmark Judgement.
The Court ordered that the couple will not be expelled until the case pending before the Civil Judge’s Court is not disposed.
Justice Jaspreet Singh issued the orders while it was dealing with a Writ Petition filed by the couple.
The Petition was against an Order issued by an Additional District Judge (ADJ) on October 20, 2020.
In his Order the ADJ quashed the order of a Civil Judge, who had given protection to the old couple from eviction.
The Court while favouring the couple, stated that the order of Civil Judge will be applicable but the only condition is that couple shall pay the all their monthly expenses for their occupation in the old-age home, which also includes the charges for the meals and electricity which is around Rs 12,000 per month.
Adding to it, the Court stated that the amount will be paid through cheque at the end of every month and the management is liable to issue the receipt of the same.
It is said that the children of the couple deserted them in 2016 only and them the two approached to the old-age home for shelter.
Following all the necessary requirement, the Couple also deposited Rs 75,000 as security money and also agreed to pay monthly charges but because of their bad behavior the management wanted to evict them.
For their protection, the two approached the Civil Court accusing that the management of the home was adamant to evict them illegally.
Howsoever, citing about their bad behavior, the management further argued that three daughters of the couple are living in the city itself and they can live with any of them.
While the Civil Judge granted protection to the couple, on the other hand, the ADJ quashed the Civil Judge’s order.
It should be noted here that the couple was living in the home of Gayatri Parivar Trust named Samarpan, on leased land of the Lucknow Municipal Corporation.
