BJP MP Nishikant Dubey: Supreme Court beaching its boundaries

On Friday after senior BJP leader and parliamentarian Nishikant Dubey launched a scathing attack on the Supreme Court and Chief Justice of India (CJI) Sanjiv Khanna, raising concerns earlier raised by Vice President Jagdeep Dhankhar over judicial overreach.

In a cryptic post on X (formerly Twitter), Dubey remarked, “Kanoon yadi Supreme Court hi banayega to Sansad Bhavan bund kar dena chahiye” (If the Supreme Court is to make laws, the Parliament should be shut down), adding fuel to an already heated debate.

Speaking to the media later, Dubey alleged that the judiciary was exceeding its constitutional mandate and accused the apex court of inciting religious and civil unrest in the country. “The Supreme Court is going beyond its limits. If one has to approach the court for everything, then there is no purpose of having Parliament or State Assemblies,” he said.

Taking direct aim at the Chief Justice, Dubey claimed, “Sanjiv Khanna is responsible for all the civil wars happening in this country.” He further questioned the judiciary’s power to direct the President of India on constitutional appointments. “How can you dictate terms to the appointing authority? The President appoints the Chief Justice of India, and the Parliament enacts the laws. How can the Supreme Court impose timelines or create new rules?” he asked.

Dubey also criticized past judicial interventions, notably the Supreme Court’s 2018 decision decriminalizing homosexuality by reading down Article 377. “Every religion—Hindu, Muslim, Buddhist, Jain, Sikh—considers homosexuality a crime. But the court unilaterally overturned it,” he claimed.

Highlighting Articles 141 and 368 of the Constitution, Dubey stated that while the Supreme Court’s interpretations are binding across the judicial system, it is the Parliament that has the exclusive authority to make laws.

The comments have sparked widespread reactions, with legal experts and opposition leaders condemning the remarks as an attack on the independence of the judiciary, while BJP circles remain divided over the tone and implications of Dubey’s statements.
