The case was regarding a appeal that was filed under Section 23 of the Railway Claims
Tribunal Act, 1987. The claimant was seeking compensation for the injury he had sustained
while travelling in a train.
Having received only a part of the demanded compensation
through the tribunal, the claimant had brought the appeal to the High Court where the
proceedings continued.
Considering the precedents, the bench noted that the claimant was
fully justified for the compensation demanded and thus the compensation amount and interest
will be applicable.
