Central Bureau of Investigation (CBI) has filed a Review Petition against the Order passed by Additional Chief Metropolitan Magistrate.
The Special Court Judge Santosh Snehi Mann also Upheld the Order passed by Additional Chief Metropolitan Magistrate, Pawan Kumar and directed Central Bureau of Investigation to withdraw Lookout Circular against Aakar Patel who is Ex-Chief of Amnesty International India.
The Special Court stated that this Lookout Circular is bad in Law and shows the lack of understanding of Law.
In the earlier order of Additional Chief Metropolitan Magistrate, Central Bureau of Investigation was not only directed to withdraw Lookout Circular (LOC) but also directed to Central Bureau of Investigation director to give Written Apology to Aakar Patel for “Taking actions on apprehensions arising out of whims and fancies of Investigating Agencies.” stated in the Order.
But the Special Court set aside the direction for giving Written Apology as because it was the lapses made by the subordinate of the Central Bureau of Investigation Director.
“The observations of the Trial Court are not of the nature of exercising power of Superintendence; they are out of concern and the Petitioner (Central Bureau of Investigation) is expected to take them in the right spirit,” “The Court’s Order setting aside the Lookout Circular does not suffer from any infirmity.” Order passed by Special Court.
Aakar Patel has suffered as he missed flights due to Lookout Circular so he is Liable for Compensation or not that need to be tried separately by the same Court.
This incident has also raised the question on the actions of Central Bureau of Investigation Officials and Liability of their actions.
