The Rajasthan High Court denied providing police protection to a couple who were in a live-in relationship by stating that since the woman was already married hence giving protection to the couple may indirectly show that the Court gives assent to such illicit relations.
The Single Bench of Justice Satish Kumar Sharma while refusing the request referred to the case of Smt. Aneeta vs. State of UP which was decided by Allahabad High Court which stated that live-in relationships cannot be at the cost of the country’s social fabric.
The Court also stated in its order that “It is well settled legal position as expounded by the Division Bench of Hon’ble Allahabad High Court in Smt. Aneeta. v. State of UP that live-in relationship cannot be at the cost of the social fabric of this country, and directing the police to grant protection may indirectly give our assent to such illicit relations.”
The petitioners were living together, the first petitioner was a married woman who left her matrimonial house and was staying with the second petitioner.
The petitioners have alleged the family for threatening them, as the woman’s family was disappointed that she was living with another man.
The petitioners prayed that their life is in danger they might be killed and requested for getting protection.
Hence, the Court denied to grant protection and dismissed the order.
However, the Court suggested to the petitioners that they can file FIR (First Information Report) or can take the available legal remedies pertaining to the situation.
