Founder of Narmada Bachao Andolan, Medha Patkar, has been convicted in a criminal defamation case filed against her by Delhi Lieutenant Governor VK Saxena. The case, filed in 2006, concluded with Metropolitan Magistrate Raghav Sharma passing the conviction order on Friday.
The court’s ruling presents a significant development in the longstanding legal battle between Patkar and Saxena. The lieutenant governor, who was previously the chief of the National Council for Civil Liberties, filed the defamation case against Patkar in response to her allegations and criticisms against him and the Narmada Bachao Andolan.
Magistrate Sharma emphasized the importance of reputation in society and its impact on personal and professional relationships. The court will hear arguments on the quantum of sentence on May 30. Patkar faces a fine or a jail term of up to two years, or both.
The Controversy
The conflict between Patkar and Saxena traces back to 2000 when the activist filed a case against Saxena for publishing advertisements against her and the Narmada Bachao Andolan. In retaliation, Saxena filed two cases against Patkar in 2006, citing “derogatory” remarks made by her on a TV channel and a “defamatory” press statement issued by her.
Narmada Bachao Andolan’s Concerns
The Narmada Bachao Andolan has been vocal in its opposition to the construction of the Sardar Sarovar Dam in Gujarat, inaugurated in 2017. The organization has raised concerns about the potential displacement of 40,000 families due to the dam’s construction, organizing protests to highlight the issue. Controversies surrounding the project have persisted since its inception in 1961 under then-Prime Minister Jawaharlal Nehru.
Future Proceedings
As the legal proceedings continue, the conviction of Medha Patkar underscores the complexities and challenges surrounding activism and development projects in India. The outcome of the sentencing hearing on May 30 will determine the consequences Patkar will face for the defamation charges brought against her by VK Saxena.
