The Delhi High Court on Thursday declined to entertain an application filed by Advocate Sudhir Mishra to take action on stubble burning in states of Punjab, Uttar Pradesh and Haryana.

The application stated that during this pandemic the people are already facing breathing and lung problems, and air pollution caused by the stubble burning is adding to their woes.

The Additional Solicitor General Chetan Sharma pointed out to the Court that the sun was not even visible in Delhi on Thursday due to the poor air quality.

He further submitted that the Covid-19 patients who had recovered are now facing repiratory problems due to poor air conditions are are rushing back to the hospitals.

The Hon’ble Court said that the Supreme Court has already taken cognizance of the case on October 16 and acted upon it by forming a committee headed by Former Judge- Justice M.B. Lokur to monitor the steps taken by these states to curb stubble burning. Now it is up to the Centre and States to take necessary steps in this regard.

The Court further said that if this Court also takes up the same matter, there would be contradictions with the Apex Court’s directions.
