The Supreme Court on Monday rejected a Writ Petition seeking directions to the Centre and States to make a quick decision on Re-opening of Schools so that students can attend physical classes with adequate safeguards.

The Petition was filed by a Delhi-based student seeking directions for the phased re-opening of Physical Schools.

The Bench of Justices D. Y. Chandrachud and B. V. Nagarathn remarked, “The complexity of the matter is such that we will have to leave it to the Governments. The Supreme Court cannot take over governance. Let Governments take these decisions.

Justice Chandrachud further stated, “The Government itself has to tread with extreme care when the issue is of exposing the younger children to the dangers of COVID-19. So the Court must be equally even more careful because there is an absence of data before us, an absence of scientific knowledge on our part and also on the part of the petitioner who has moved the Court.

On the other hand, the Counsel for the Petitioner contended that malls and restaurants have been opened, and emphasised the mental and psychological impact of the closure of schools on students.

Following the adverse remarks by the Bench, the petitioner’s counsel requested permission to withdraw the Petition.

Accordingly, the Petition was considered withdrawn and dismissed.
