The Punjab and Haryana High Court has declared that landowners who come before the Court have the Right to Reclaim their property if Compensation for Acquisition is not paid within a month.
The order came after High Court Justice Anil Kshetarpal termed the amount charged by the Land Acquisition Commission as “Shocking.”
Collector in 2017 had not been paid and the owners, who were “Deprived of their precious Land”, were being made to run from pillar to post.
Rishpal Singh and other Petitioners filed a Petition against the State and other Respondents, which was brought to Justice Kshetarpal’s attention.
Justice Kshetarpal remarked that the Respondent took possession of the acquired land without paying full compensation, as stated by an Executive Engineer of Muktsar. In actuality, it was Alleged that 52% of the compensation money had not been paid since the State Government had not released it.
After dismissing the Writ Petition, he ordered the Land Acquisition Collector to release the sum to the Petitioners within a month if there was no Dispute, failing which the Petitioners would be entitled to reclaim their property.
“This Court is conscious of the fact that such a step may cause inconvenience to the public, however, the Petitioners, who have been deprived of their property, are required to be adequately compensated,” Justice Kshetarpal stated.
