The Supreme Court issued Notice on a Writ Petition challenging the eligibility criteria for the course of Doctorate of Medicine (DM) prescribed in the Schedule to the Postgraduate Medical Education Regulations 2000.
A Bench of Justices DY Chandrachud and BV Nagarathna issued a notice returnable within two weeks on the Petition filed by the Society of Indian Academy of Medical Genetics, a body of experts in the field of Medical Genetics in India.
Advocate Sudhanshu S Chaudhari, appearing for the Petitioner, argued that the NEET-SS eligibility criteria are in conflict with the National Medical Commission (NMC) Guidelines.
The said Guideline only allows applicants from three clinical disciplines, namely Medicine, Pediatrics, and Obstetrics-Gynecology, to apply for Doctorate of Medicine (DM) or Doctorate of National Board (DrNB).
The Counsel further stated that Elite Institutes such as AIIMS and PIGMER, Chandigarh, only admit students to DM/DrNB programmes from the aforementioned three disciplines.
The Petition also challenges the Prospectus of NEET-SS 2021 dated August 31, 2021, published by the NMC to the extent it allows aspirants from a broad range of specialities to apply for the course of DM/DrNB.
Accordingly, the Court issued a Notice after recording the submissions of the petitioner.
