The Gujarat High Court chastised the Unique Identification Authority of India on Monday for ‘showing the law to the Court’ and challenged to conduct contempt prosecution against it for refusing to share Aadhaar information with an IPS officer tasked by the Court with tracing a person who went missing from a school hostel years back.
Jigar Jadav of Deodar town is involved in the crime. He was a student at the Jagruti Uttar Buniyadi Vidhya Mandir in Devas and a resident of the Dr Babasaheb Ambedkar Kumar Chhatralay.
He went missing in October 2011, and his father sought the Ca a decade later, seeking for help in finding him.
As there were no leads as to the boy’s location, the High Court investigated the potential of tracing him using information deposited with the Unique Identification Authority of India, if any.
The Aadhaar authority was unable to locate any information on the boy.
The Unique Identification Authority of India’s deputy director, on the other hand, filed an affidavit and told the HC that it could not have ordered the disclosure of sensitive information without the person’s consent.
He also used Supreme Court precedent to support his point of view.
The HC did not agree with the UIDAl’s request to erase its January 11, 2022, order to disclose material with the investigation.
An enraged Bench of Justices So- nia Gokani and Mauna Bhatt said, “You must understand that you are dealing with human life. All powers exist because of the Constitution, and the first and most important feature is to protect the interests of all citizens.”
The HC said, ” Don’t show us the law (and say) that court cannot force it and that we will not do it… Once your counsel has said it, the party has no business to come and tell us that we are not going to abide by the order”
