The Supreme Court of India has permitted the Chandigarh Administration to submit a report on the survey in progress to the plea over floor wise building plans in Chandigarh within a week.
The Apex Court has asked the Punjab and Haryana High Court, where the matter is pending, to proceed with the hearing of the petition considering the report to be submitted next week.
The Supreme Court has requested the High Court to adjudicate the dispute at the earliest, preferably within two weeks.
Earlier on August 9, the Top Court during the hearing of Special Leave Petition (SLP) filed by a Chandigarh resident, Mamta Gupta, had stayed an order by the Punjab and Haryana High Court directing the Administration of Chandigarh to conduct a physical survey of properties/buildings in Chandigarh, where there has been a transfer of shares.
The petition by Mamta opposed the survey.
It was in July, when the High Court had directed that those residential properties transferred or sold after December 31, 2019, wherein the shares were transferred to a person outside the family of the original owner, be surveyed.
The High Court Order had been passed considering a batch of petitions pending since 2016, sought for prohibition on conversion of residential plots into apartments. Residential plots in Chandigarh are meant for single-dwelling units.
“However, in recent years, apartments are being sold floor-wise to multiple owners, which would destroy the city and put additional burden on infrastructure,” the batch of petitions stated.
The matter was taken up in the High Court on September 7, but was adjourned for September 16, since Apex Court has already stayed its earlier order.
