The Walmart-owned Flipkart has approached the Supreme Court and has filed an appeal against the Karnataka High Court’s order.
Flipkart in its written appeal has stated that the Court has failed to recognize the main issue that the Competition Commission of India (CCI) didn’t comply with its requirements before seeking directions for investigation.
Flipkart further contended that CCI has failed to mention which agreement they have found violative of competition law rules and also has not shown the existence of any prima facie findings on any such violation of the Competition Act.
A division bench of the Karnataka High Court quashed the separate petitions filed by both Amazon and Flipkart, by stating that if the companies have not done any violation then they should not fear any sort of investigation.
The Karnataka High Court permitted the CCI for investigating Flipkart and Amazon India for violating the competition law.
