The Delhi High Court refused to entertain the PIL on Thursday that seeked it to “advise” the Delhi LG and the city police commissioner to ensure that the people have a supply of clean, hygienic milk.
No law empowered the court to “advise” the LG, according to a Bench headed over by Chief Justice Satish Chandra Sharma. The Bench, which also comprised of Justice Subramonium Prasad, asked the petitioner, a lawyer, “Under what jurisdiction can the high court advise the LG? I have not seen any provision in the Constitution which empowers the high court to advise the LG.”
According to the petitioner, who relied news reports, “cattle were dying on the road” and were “feeding on plastic.”
The petitioner said that Delhiites’ health was being affected by the “neglected, abandoned, and pathetic condition of the cattle.”
According to the petitioner, the court has the power to advise the LG under its “advisory jurisdiction” and that the matter at in her plea concerned to the right to life guaranteed by Article 21 of the Constitution. She also said in her plea that the cattle are feeding “contaminated food” and dirty sewage from the drains.
The court stated, “We don’t deliver judgments based on reports… We know of our limitations.”
The petitioner withdrew the plea after the court indicated that it was inclined to impose a “heavy cost.”
