In a recent hearing, the Delhi High Court expressed reservations about issuing directives to control the proliferation of “deepfake” content generated through Artificial Intelligence (AI) technology.
The court, considering a PIL filed by advocate Chaitanya Rohilla, discussed the complexities involved in regulating deepfakes and suggested that the government, with its extensive resources, would be better equipped to find a balanced solution.
The petitioner urged the court to block websites creating deepfakes and establish guidelines for their permissible use. However, the court acknowledged the intricate nature of the issue, emphasizing the challenges in controlling the internet in today’s borderless world.
Acting Chief Justice Manmohan highlighted the government’s role in addressing the matter, stating, “It is only the government with all its resources that can do it. They have the data, they have the wide machinery, they have to make a decision about it.”
The court also acknowledged the positive applications of deepfake and AI technology, such as in filmmaking. The petitioner’s counsel suggested issuing guidelines to hold private parties accountable for the misuse of these technologies, proposing measures like requiring websites to disclose AI-generated content.
Despite the complexities, the petitioner emphasized the need for accountability in the misuse of AI, comparing India’s regulatory progress to that of the European Union and the United States.
The Central government assured the court that it is actively considering the issue, and the matter has been listed for further hearing on January 8.
