The Delhi Court has asked the investigating officer to submit a verified report on the application which is filed in the interest of Asif Iqbal Tanha, the student activist who had been recently granted bail by the High Court of Delhi with regard to the case of Delhi Riots.
The application states that in accordance with his release he will be residing in a new address in Delhi’s Jamia Nagar.
The Additional Session Judge Amitabh Rawat has directed the Investigating officer to submit the report for the aforesaid address, by the next hearing regarding the Delhi Riots larger conspiracy case which is ought to be held on 15th July,
The Court issued orders for his release last week, after observing the argument of Delhi police that they need more time in order to verify the address of the accused and sureties. This reason wasn’t seen as sufficient enough to keep him imprisoned.
Particularly, in the case of Tanha, the police contended that he had no passport and that even the phone number was provided by Officer Special Cell to him.
Whereas, Special Public Prosecutor Amit Prasad objected to the application and stated that the said address was incorrect because he never resided there. Tanha’s permanent address which is in Jharkhand has been verified along with the status of both the sureties.
Tanha’s lawyers contended that he used to reside at that address prior to his arrest and due to his arrest the tenancy had expired.
The Court after hearing all the submissions directed the investigating officer to file a detailed verification report with regard to the address and to submit the report on 15th July.
