Gujarat High Court observed that when deciding Bail Pleas an Important Consideration is delay In Concluding the Trial.
The Bench of Justice Gita Gopi granted Bail to the accused under the Central Goods and Services Act of 2017.
The Accused before the High Court said that the Applicant Submitted that he was arrested without any Evidence/Material and also that he is a Tax-Paying Citizen and is Licensed Under the Goods and Services Tax regime for Iron Scrap Business and also added de-sealing Official documents related to the Business .
On the other hand, the Respondent Authority submitted that there was No Stock register found at the applicant’s shop and as the Officials were unable to find the Principal Place of Business, it is assumed that the place only exists on paper and is a Shell Company.
After hearing the arguments, the Bench referred to Sanjay Chandra vs CBI, wherein the Apex Court held that while deciding Bail Pleas, the delay in concluding the Trial is a relevant consideration.
In this context, the Bench opined that the Trial in the instant case will take time to conclude and therefore, Granted Bail to the accused on a Personal Bond of Rs 1 lac.
