Complaint Filed Against President of State Consumer Commission Evicted For Judicial Impropriety

The Consumer Courts Advocates Association (CCAA) for Maharashtra and Goa has filed a Complaint against Dr. Santosh K Kakade, acting President of the Maharashtra State Consumer Disputes Redressal Commission (SCDRC) for Judicial Impropriety after he adjudicated a case in which he was the Party.

The cases started when a Medical Negligence complaint was filed before the Solapur District Forum where a hospital was the first Respondent and Kakade was the Second Respondent.

Kakade had even responded to the complaint. The decision to dismiss the complaint was appealed to the State Consumer Disputes Redressal Commission (SCDRC).

The appeal was accepted in 2002 and adjourned with no appointed date for resumption and the Appeal was finally heard in August 2021 before Kakade. On the same date, he dismissed the Appeal for Lack of Prosecution.

Dr. Gopinath Shenoy, a Member of the Consumer Courts Advocates Association (CCAA) discovered the fact when he presented a Certified Copy of the order to the Association’s Managing Committee.

The Committee asked the former to file a formal complaint which she did and the committee decided to call an Emergency Meeting while Kakade allegedly got wind of the certified copies and accepted the disposed of appeal and reviewed his August 2021 order.

He was also accused of Mistreating Bar Members and using Abusive Language in Several Instances according to the complaint filed on February 26.

According to the complaint, Kakade’s Family Members were involved in a company called Core Indian Institute of Legal Medicine Private Limited, which purportedly provided legal advice to Medical Professionals. In response to this complaint, they called an Emergency General Body Meeting on February 27 to hear the complaints of several of the Association’s Lawyers.
