The Central government has reported that Twitter is not functioning in accordance with the new Informative Technology Rules and has lost its immunity’ to the High Court of Delhi.
Lawyer Amit Acharya filed a petition against Twitter for not following the commands given in new Information Technology rules, he alleges that he came across some defamatory tweets and when desired to register a complaint he found contact details on Twitter’s website/mobile app of grievance officer located in the US.
The intermediaries like Twitter, Google, Facebook, Koo, ShareChat and others get immunity under the IT Act. ‘Immunity’ is a protection that is provided to these intermediaries by IT Act.
The Court issued a notice to the social media giant and orders for getting a reply within three weeks and set the date for further hearing on July 6.
When the grievance officer Dharmendra Chatur resigned, then Twitter appointed US-based Jeremy Kessel as its new resident grievance officer for India, which was against the new IT Act rules.
Twitter reportedly said to the Court that it’s in the final stage of appointing a new resident grievance officer.
During farmers’ protests as well there was a Twitter and Union government controversy when Twitter restored the tweets which were made deleted by the government on the grounds of inciting violence.
