Bombay HC: Transgender Person seeks help for Alleged Detained Lover by Parents

A transgender person has approached the Bombay High Court seeking help with regards to her lover who has been allegedly detained by her parents.

The Bench comprising Justice Shrikant D. Kulkarni and Justice V. K. Jadhav requested the APP to look into the matter.

The Petitioner stated that the transgender person’s name is Pooja Kumari (earlier Bunny Prajapati) and the other girl who has been allegedly detained also goes by the name Pooja.

Both of them are in love with each other and were in each other’s company voluntarily as stated by the petitioner.

A missing person’s report was filed by the girl’s parents at the Washi Police Station and also a petition was filed by them in the Court of the Chief Judicial Magistrate.

The girl was later found and handed over to her parents as there was no order from the Court regarding this matter.

The Counsel stated that at present the girl is in custody of her parents and they are not allowing her to contact the Petitioner.

So the girl being a major is being wrongfully detained by her parents. Therefore a Habeas Corpus Plea was filed in order to produce her before the Court.

The Court directed the Counsel of the Petitioner to submit before the Court a previous Judgement given by the Apex Court in the case of Navtej Singh Johar vs. Union of India wherein it was held that the social status of a transgender person and also the “normal person”, if residing with the transgender person, by consent.

The next hearing will take place on 31st August.
