Supreme Court has raised concerns regarding the timing of Delhi Chief Minister Arvind Kejriwal’s arrest just before the commencement of general elections. Mr. Kejriwal, who challenged his arrest in the Delhi liquor policy case, saw the apex court questioning the Enforcement Directorate (ED) on the circumstances surrounding his detention.
Supreme Court bench of Justice Sanjeev Khanna, pressed the ED to clarify whether it had the authority to initiate criminal proceedings without prior judicial scrutiny in the case. Justice Khanna emphasized the significance of safeguarding life and liberty, underscoring the need for transparency in the arrest process.
Supreme Court pointed out the absence of material evidence linking Mr. Kejriwal to the alleged offense, unlike in the case involving former Delhi Deputy Chief Minister Manish Sisodia.
Supreme Court Expressing concern over the prolonged gap between the initiation of proceedings and Mr. Kejriwal’s arrest, the court directed the ED to provide an explanation for the delay.
Mr. Kejriwal, currently under judicial custody in Delhi’s Tihar Jail since his arrest on March 21, continues to serve as Chief Minister from confinement.The Supreme Court’s directive to the ED follows its notice issued on April 15, seeking a response to Mr. Kejriwal’s challenge against his arrest.
Earlier, the Delhi High Court upheld Mr. Kejriwal’s arrest on April 9, citing his failure to comply with summons and cooperate with the investigation.
As Mr. Kejriwal remains in custody, the Aam Aadmi Party’s (AAP) election campaign is being managed by party leaders Atishi, Saurabh Bharadwaj, and other senior colleagues, with support from Mr. Kejriwal’s wife, Sunita, who is actively engaging with his supporters.
The Supreme Court has directed the ED to furnish a response by Friday, signaling a crucial juncture in the legal battle surrounding Mr. Kejriwal’s arrest.
