A Sessions Court in the district of Sagar, Madhya Pradesh sentenced a 22-year old brother along with his 42-year old uncle to death for raping, sexually assaulting and murdering their 12-year old sister and niece, respectively.
Claiming it to be the “the rarest of the rare”, the Special Sessions Judge of Banda town in Sagar District Umashankar Agrawal said that the case “warrants a capital punishment”.
The minor girl went missing on 13th March 2020 following which her father registered a complaint on 14th March.
During investigation, the Police recovered her body from an agricultural farm. However, her head was found 45 feet away from her body. This indicated that the girl must have been beheaded by the accused.
The post mortem report confirmed gang-rape of the minor and the police filed a chargesheet against her brother and uncle under sections various sections including 302 and 376 of the Indian Penal Code and under sections 5 and 6 of the POCSO Act.
The accused Ramprasad Ahirwar and Vanshilal Ahirwar had reportedly raped and sodomized the 12-year old girl before beheading and killing her with a sickle.
“The sickle was recovered from the house of one of the accused. The statement of 29 witnesses was recorded. The DNA and post mortem report corroborated the prosecution’s charges,” said Special Public Prosecutor Tahir Khan.
The proceedings of this heinous crime case was closely monitored by Public prosecution director Vijay Yadav who also guided during the advocacy of the case.
