Indian Medical Association: Seeking Guidelines for Doctors’ Protection in Medical Negligence Cases

The Indian Medical Association has approached the Apex Court seeking Guidelines to ensure Doctors’ safety across India from Illegally being booked by the Police on serious Charges in relation to Medical Negligence Complaints.

The instant Plea filed was filed because of the Death of Dr. Archana Sharma from Jaipur who Committed Suicide on 20.03.2022 after she was Charged for Murder.

The Petition stated that now the Doctors are Physically Assaulted by the relatives of the patients if there is a delay in recovery or treatment of patients.

The Petition asked for several prayers such as the compensation for the doctors who have died of such incidents and to Order a Central Bureau of Investigation (CBI) to look into the circumstances that led to the doctor’s death.

In this context, it was Prayed that Police and Officials should be trained to deal with such matters and they should be specifically qualified to deal with such Cases.
