In the Hathras gang rape case on Wednesday, victim’s family filed a Habeas corpus writ petition in the Allahabad High Court. In the petition, the family of the deceased girl claimed that it was being illegally confined to its house by the Hathras administration.
The petition has been filed by a social worker named Surendra Kumar on behalf of the victim’s family. This habeas corpus writ petition, filed by the family members of the victim, is listed on today for hearing.
The petitioner urges the court to order the district administration that the “family members be released from illegal confinement and allowed to move out of their house and meet people”
In the petition, it has been claimed that e family members of the victim were illegally confined in their house by UP police and that they were not permitted to visit anybody or to meet anyone”.
The plea also claimed that because of the limitations imposed by the district administration, certain persons are unable to visit the victim’s relatives.
It has been further alleged that “though, at a later stage, a few people were allowed to meet the petitioners, the district administration is still not allowing them (the petitioners) to move out of their house at free will” through this argument in the plea, petitioners have alleged that the freedom of speech and expression, as well as the right to receive the information, is being violated.
The habeas corpus writ petition is filed before high court when a person is illegally detained. During the court proceedings, if the court finds that the person is illegally detained, then it can order for the release of that person.
