The Ernakulam Court rejected rejected Kerala Chief Minister’s former Principal Secretary M. Sivasankar’s bail plea by accepting all arguments of the customs department in the gold smuggling case.
Court observed that as per the customs department, Sivasankar had sought refuge in a hospital for fear of arrest. The court pointed out that Sivasankar had concealed the fact that he had more than one mobile phone and the medical certificate issued for him did not mention that he is seriously ill. He has not taken any leave yet due to health reasons, it stated.
Dismissing the bail Court said that the probe could be sabotaged using high-level links of the accused,”There is evidence against Sivasankar in the gold smuggling case as the co-defendants have given strong statements against him,”
Kerala Chief Minister’s former Principal Secretary had approached the court seeking natural bail as the Enforcement Directorate itself said that the charge sheet filed in the court and the investigation both were not complete.
In its report customs department said in the court that Sivasankar had misused his position as Principal Secretary to the Chief Minister for gold smuggling.
Customs department opposed the bail plea and gave an affidavit that Sivasankar was one of the masterminds in the gold smuggling.
