Calcutta HC directs administration to issue protective orders in all illegal activities in Sundarbans

The Calcutta High Court has taken cognizance of a report about the disorderly state of affairs in the Sundarbans. Said Court has issued notifications to local administrators instructing them to issue protective orders restricting all illegal operations in the nearby areas.

The Division Bench comprising Chief Justice Thottathil B. Radhakrishnan and Justice Arijit Banerjee was hearing the writ appeal relating to critically significant issues addressing the ecologically fragile area, Sundarbans.

The Court additionally commented that

The Court also directed the District Magistrates of the regions of South 24-Parganas and North 24-Parganas or any authoritative body exercising power under Section 144 Code of Criminal Procedure to issue certain directives in the interest of the area.

The directions included the power to issue restraining orders for illegal activities, power to District Magistrates to ensure that no part of the Sunderbans is converted for any other purpose.

The Hon’ble Court also conferred power upon all authorities’ bodies to check that any violation of the order is dealt with as per law,

Further, the Court likewise clarified that in cases of an occurrence of any violation or breach of the bearings by any of the authorities, strict actions imposing civil and criminal liability will be taken.

The Court also stated that the subject matter of the said plea request be immediately communicated to the Registry to the District Magistrates and Collectors of the regions of South 24-Parganas and North 24-Parganas and the Director-General of Police

The Registry was likewise notified to impart the request to the Chief Secretary of the State of West Bengal, and direct all subordinate officials under the State Government, to execute the orders as far as possible in law.

The Court additionally permitted the State Government and the petitioner to produce all documents in consideration of the matter before it.
