A special Uttar Pradesh ATS Court has ordered the investigating authorities to invoke additional serious Sections of IPC on the eight people who have been accused in the Unlawful Conversion case.
Uttar Pradesh Anti Terrorist Squad had appeared before the Court and requested to invoke Sections 121a and 123 of IPC on the accused.
Section 121a of the Indian Penal Code deals with Conspiracy to Wage War against the Government of India while 123 deals with Concealing with Intent to facilitate design to Wage War.
Earlier the ATS workforce had approached the Chief Judicial Magistrate of Lucknow to incorporate these sections into the FIR of the accused.
The ATS team stated that while investigating they found that the group of accused were not only involved in Illegal Conversion but were also planning to create a rift between different religions and to disrupt the Government.
The Magistrate however stated that Lower Courts do not have the authority to pass any Judgements or decisions relating to Sections 121a and 123 of the IPC.
The ATS team then moved with their Appeal to the ATS Courtroom.
The accused names are Umar Gautam, Mufti Jahangir Kasmi, Irfan Sheikh, Salauddin Zainuddin Sheikh, Prasad Rameshwar Kavre alias Adam, Arslan alias Bhupriya Bando, Kausar Alam and Faraz Shah.
Earlier these accused have been charged under Sections 417, 120b, 153a, 153b, 295a, 298 and Uttar Pradesh Prohibition of Illegal Non-secular Conversion Act, 2021.
The next hearing on this matter will take place on 14th September.
