U.S. Supreme Court orders Biden to revive Trump’s Remain in Mexico Policy

The Supreme Court of the United States issued an order declining to rescind an immigration policy ‘Remain in Mexico’ initiated by Former President of US Donald Trump, that commands many asylum-seekers to wait outside the United States for their cases to be decided.

The Supreme Court denied President Joe Biden’s bid for suspension of Trump-era border policy regarding Migrant Protection Protocols (MPP) and directed Biden’s Administration to comply with the Lower Court’s ruling to reinstate the Policy.

U.S. District Judge Matthew Kacsmaryk ruled earlier this month that, “The Biden Administration did not provide an adequate reason for getting rid of the policy, and that its procedures regarding asylum-seekers who enter the country were unlawful. The memorandum rescinding the Migrant Protection Protocols was arbitrary and capricious.”

Texas and Missouri filed the lawsuit in MPP issue alleging the Biden Administration illegally terminated the program earlier this year.

Arguments presented by Texas and Missouri were agreed by the District Court, finding that the Biden Administration’s rescission of the MPP policy was unlawful.

The three-judge Panel of the Fifth Circuit Court of Appeals sided with Kacsmaryk’s order, stating Biden’s claims Arbitrary

Subsequently, upholding the Lower Court’s decision, ruling by the Top Court is a judicial setback for the Biden Administration as they are legally mandated to implement the Trump’s Border rule.

However, the Biden Administration cannot implement the immigration policy without the Mexican Government agreeing to accept migrants returned by the U.S.

The operational plans to reinstate the Remain-in-Mexico rule is yet to be notified by the Department of Homeland Security.
