The Supreme Court of India will hear a plea filed against the order passed by the Patna High Court, in relation to the wrong evaluation of the petitioner’s land.
The division bench comprising of Justice Sanjay Kishan Kaul and Justice Hemant Gupta will take up the matter in regard to the petition filed.
The petitioner claims that the compensation provided to him in exchange for land acquired for development purposes is on the basis of wrong evaluation. The Petitioner states that he had been provided less amount of compensation considering land as residential property when it actually was a commercial one.
The present appeal by the petitioner is challenging Patna High Court’s order which dismissed the Letter Patent Appeal (LPA) filed by the petitioner for dropping of contempt proceedings against him.
The contempt proceedings initiated against him were for non-compliance with the order passed in a writ petition filed earlier by the petitioner itself.
The dismissal of the petitioner’s appeal in the Patna High Court was with regard to the findings of a five-member committee that examined the objection of the petitioner in accordance with law and take into consideration the objection raised by them, after giving them a proper hearing.
The Committee found that the land in conflict was residential in nature and not commercial.
Later, the petitioner filed an LPA that was also dismissed by the High Court on the ground of non-maintainability and barred by time.
