Supreme Court tags petition seeking Uniform Age for Marriage

Supreme Court of India sought its response in the plea seeking transfer of pending petitions before Rajasthan High Court and Delhi High Court, on subject matter demanding uniform age for marriage for both men and women.

Supreme Court tagged the petition that challenged the provisions prescribing different age for eligibility of marriage.

A vacation bench of Justice AM Khanwilkar refused to issue any notice in this regard and directed the plea to be readily decided by the appropriate bench.

Shahida Quraishi filed a petition which challenged provisions prescribing eligible age of 18 years for women and 21 years for men for marriage. She challenged Section 5(iii) of the Hindu Marriage Act, 1955, Section 4(c) of the Special Marriage Act, 1954, Section 2(a) of the Prohibition of Child Marriage Act, 2006, Section 60(1) of the Indian Christian Marriage Act, 1872, and Section 3(1)(c) of the Parsi Marriage and Divorce Act, 1936.

The petition states that age differentiation prompts gender inequality that violates Constitutional Rights secured under Article 14, 15 and 21 of the Indian Constitution.

The petition for age differentiation tagged along with the petition seeking uniform age for marriage was filed by Advocate Ashwini Kumar Upadhyay. He sought to transfer the petitions that are pending in the Rajasthan HC and the Delhi HC. The transfer plea was filed to avoid multiplicity in litigation and conflict in views by maintaining equality and justice in petitions with similar subject matter.
