The Supreme Court of India on January 11, 2022 stated that the litigation happening in regards with the Mullaperiyar Dam in Kerala is not against anyone and that the Public Interest Litigation filed pertaining to this is for the safety of people residing near the Dam.
A Supreme Court Bench headed by Justice A M Khanwilkar and comprising of Justices Dinesh Maheshwari and C T Ravikumar stated that the advocates of both the parties involved will be having a joint meeting pertaining to the litigation.
The Supreme Court Bench stated, “The (advocates) have assured the Court that they will articulate the issues on which there is consensus and also on which there is difference of opinion and submit a note in that regard before the next date of hearing.”
The Bench during the hearing observed that first the core issues of the matter need to be decided, when a lawyer raised a question in regards with seepage of data. The Bench also stated that a committee has been set up pertaining to the water level issue of the dam and safety issue of the public.
The Supreme Court stated, “This is public interest litigation in the sense that safety and security and health issues are involved of the persons staying around that dam. Therefore, all of you should help us in identifying the core issues which we need to answer in the judicial side. We are not sitting here to do administration of the dam.”
The matter pertaining to the Mullaperiyar Dam is kept for further hearing on the second week of February, 2022 by the Supreme Court. The Apex Court also ordered that the written note by the advocates should be submitted by February 4, 2022.
