Supreme Court: Right to be Considered for Promotion is Fundamental Right

The Supreme Court, while setting aside Allahabad High Court Judgement of December 04, 2019 observed that the Right to be Promoted is not a Fundamental Right but Consideration for Promotion has now evolved to be a Fundamental Right.

A Bench of Justices D Y Chandrachud, Vikram Nath and B V Nagarathna, emphasized of the right to be considered for promotion as a Fundamental Right.

Also, the Constitution Bench in Ajit Singh case stated that, if a person who is both eligible and meets the criteria for promotion, is still not considered for promotion it is clearly a Violation of Fundamental Right.
