The Supreme Court dismissed a plea of Supertech seeking modification of its August 31 Order directing to demolish two of its 40-storey towers at its Emerald Court Housing Project in Noida.
Supertech had filed a plea in the Supreme Court proposing the demolition of only one of the two towers.
The Bench of Justices D. Y. Chandrachud and B. V. Nagarathna stated, “The grant of such a relief is in the nature of a review of the judgement of this Court and in various decisions.”
The Court further stated, “The filing of applications styled as ‘miscellaneous applications’ or applications for clarifications in the guise for review cannot be countenanced. Such an attempt is not permissible in miscellaneous applications. “
In its Miscellaneous Application, Supertech Ltd stated, “The underlying basis of the proposed modifications is that if the same are allowed, it would save crores of resources from going to waste inasmuch as the applicant has already put materials worth crores of rupees in the construction of the Towers T-16 (Apex) and T-17 (Ceyane).”
On August 31, the Supreme Court ordered the demolition of Supertech Ltd’s twin 40-story towers under construction within three months for violating building norms in collusion with Noida officials.
However, the Court dismissed the Petition, citing a lack of substance.
