The Supreme Court of India rejected the plea for postponement of final year examinations of Post Graduate Medical students. The plea was filed by group of Post Graduate Medical Residents.
As a matter of national level, a vacation bench constituting of Justice Indira Banerjee and MR Shah observed that, the dates for exams are to be announced by various universities all over the country, hence no general order can be passed by the Court.
“How can we pass a general order when there are 100s of universities involved all over the country?”, Justice Banerjee asked.
Representative lawyer of petitioners, Senior Advocate Sanjay Hegde communicated to the Court that, simultaneous obligation for those who attend their COVID duty were not able to prepare for their exams.
“We are forced to make a choice between attending Covid duty and studying for exam. We have been doing it for a very long time in extra ordinary circumstances.”, Hedge stated.
The Court said that, there understand the difficult situation of the students, but no authority is in position to postpone the exams, moreover. implementation of order across different universities is not suitable.
The petitioners sought directions for waiving off the examinations, the Bench observed that, as the matter of future of medical system students cannot be promoted. As the matter of reasonable time to be granted for preparation of exams, the Court declared it a ‘subjective matter’ upon which order cannot be passed.
The vacation Bench issued notice to the Union Government and National Medical Commission on these prayers and advised MD students to keep a check on the schedule of the Final Year Post Graduate Exam 2021 and prepare accordingly.
