The Supreme Court dismissed a Plea contending the retrospective change in the 2018 appointment order of Sanjay Kumar Mishra as Director of Enforcement Directorate (ED) and also ruled that the tenure should not be extended.
The matter was adjudicated by Justice L Nageswara Rao and the bench stated, “The tenure of officers who have attained the age of retirement should be extended in rare and exceptional cases only.”
The petition was filed by NGO Common Cause challenging retrospective changes in the appointment order of Sanjay Mishra as the director of the ED, the central agency probing financial crimes.
While delivering the judgement the Apex Court said, “We do not intend to interfere with the appointment of the current ED Director. His tenure is already coming to an end in Nov 2021. But should not be extended beyond that”.
Mr Sanjay Mishra was appointed as the ED Director for a period of two years on November 19, 2018. But on November 13, 2020, the appointment letter was revised retrospectively by the central government and his tenure of “two” years was replaced by “three” years.
The Petition had been filed for further extension.
