The Supreme Court permitted the Central Bureau of Investigation to coordinate with the Interpol to trace an Egyptian Accused of kidnapping his child and fleeing the country in Breach of Orders of the Bombay High Court, which had given Custody of the child to his Deceased mother’s sister.
According to Interpol, “A Yellow Notice is a Global Police alert for a missing person. It is published for Victims of Parental Abductions, Criminal Abductions (kidnappings) or unexplained disappearances. The Yellow Notice can also be used to help identify a person who is unable to identify himself or herself.”
Appearing before a Bench of Justices C Y Chandrachud, Sanjiv Khanna and Surya Kant, Additional Solicitor General Aishwarya Bhati said since the Egyptian, Khaled Kamal Hussein Mohamed Kassem, has neither responded to the Supreme Court Notice, the Central Bureau of Investigation could alert the Interpol and provide information for Issuance of Yellow Notice to trace the person. The Bench allowed the Central Bureau of Investigation to take up the Issue with Interpol.
In its last Order, the Bench headed by Justice Chandrachud had said, “The Central Bureau of Investigation shall issue a Red Corner Notice to secure the presence of the first Respondent – Khaled Kamal Hussein Mohamed Kassem, who is a Foreign National”.
When the Supreme Court issued Notice to Kassem on the Appeal filed by the child’s aunt and grandmother, a Lawyer appeared for him but later he sought discharge saying he was not receiving any instruction from Kassem. Thereafter the Supreme Court had impleaded the Central Bureau of Investigation to search out Kassem and the child.
