The Supreme Court has ruled that Abdul Nazir Maudany, an accused in the 2008 Bengaluru blasts case, can now travel to and stay in Kerala as his presence is no longer required during the trial proceedings. This decision comes after the bench of Justices AS Bopanna and MM Sundresh relaxed the bail conditions imposed on Maudany [Abdul Nazir Maudany v. State of Karnataka].
On Monday, the bench passed the order, granting the People Democratic Party (PDP) leader the freedom to reside in Kerala. Maudany had previously requested the relaxation of the bail conditions set by the Supreme Court back in July 2014, when he was granted bail due to his health issues.
One of the conditions stipulated that Maudany must remain in Bengaluru and refrain from leaving the city. Consequently, he has been residing in Bengaluru since then. However, senior advocate Kapil Sibal, representing Maudany in the top court, informed the court that the trial proceedings concerning his client had concluded.
Taking this information into account, the Court granted Maudany’s application and allowed him to reside in Kerala.
It is worth noting that in October 2021, the Court had rejected a plea by Maudany to relax his bail conditions and permit him to travel to Kerala.
Similar requests made earlier this year to tend to his ailing family members in Kerala were also denied.
The 2008 Bengaluru blasts resulted in the death of one person and left 20 others injured. Maudany is listed as the 31st accused in an additional charge sheet filed by the police.
The Supreme Court’s decision reflects the evolving circumstances of the trial and Maudany’s improved health condition, allowing him the opportunity to reside in Kerala during the proceedings.
