Supreme Court grants Interim Protection to man accused of outraging wife modesty

The Supreme Court has granted interim protection from arrest to Madan Lal, a teacher charged with offences punishable under Sections 498A, 323, 354 and 406 of the Indian Penal Code.

The Bench of Justices Hemant Gupta and Aniruddha Bose passed the order saying that no coercive action would be taken against him subsequent to the anticipatory bail plea filed by Advocate Abhishek Gupta on behalf of the petitioner. The Court issued notice to the State.

The plea was filed challenging Rajasthan High Court’s Jaipur Bench, where the counsel submitted that the accused is a government teacher nearing retirement and hence custody of the petitioner is unwarranted.

The Public Prosecutor along with Madan Lal’s wife had opposed the bail application before the High Court contending that there is an allegation on him of outraging his wife’s modesty.
