Delhi Police alleged to the Supreme Court that a Delhi city government prosecutor was intentionally hiding relevant information regarding a case related to the Delhi Riots 2020.
The Supreme Court bench comprising Justice Ashok Bhushan, Justice R Subhash Reddy and Justice MR Shah, heard the appeal brought to the court by the police, challenging the bail order of an accused who was granted bail in August last year.
Additional solicitor general (ASG) Vikramjeet Banerjee representing the Delhi Police said that the prosecutor in question was aware of the fact that the Centre had appointed special counsels to deal with the riots but chose to not tell the investigative agency during the accused’s (by the name of Iliyas’) hearing.
The ASG said that the prosecutor had in fact made a false statement inside the Delhi HC by claiming to have informed the deputy police commissioner of this information when he had not.
Furthermore, the ASG also stated that two police officers were not even informed of the bail hearing.
The petition was filed by Delhi Police on grounds of the prosecutor withholding information and in it, they claimed that the same prosecutor had withheld information from them before as well.
The Supreme Court bench however said that the procedure for such a situation was to ask the High Court to review its order instead of appealing to the Supreme Court, stating in their order that the special leave petition stands dismissed as they see no grounds to entertain it.
The accused was booked under attempted murder, rioting and arson according to the FIR report lodged at Dayal Pur police station.
