The Supreme Court on November 18 ordered the testing of a Mobile App built by Delhi Police by Experts, in response to a 2018 matter in which the principal issue is connected to using technology in Crime Investigation, particularly in having the Crime Scene photographed/videographed.
The Bench also requested a report from experts on whether the photographs and videos taken and posted on the Delhi Police’s app are entirely tamper-proof and could be used as Evidence in a Criminal trial.
The Supreme Court was debating in 2018 whether videography of the scene of a Crime or the scene of a recovery during an Investigation should be required to instil confidence in the Evidence gathered.
A complete response on behalf of the Union of India as well as the Delhi Police was filed on record pursuant to the Supreme Court’s decision of August 24, 2021, and the Delhi Police notified the Court that it has built an App for the abovementioned purpose.
It was submitted to the Court that as part of a pilot initiative, I.Os from 15 Police stations in the South Delhi District have been taking photos and films of Crime scenes and uploading them via Crime scene photography.
The Court stated at the outset that these advancements are encouraging and will go a long way toward leveraging technology in Criminal investigations, particularly in having the Crime scene photographed or videographed.
The Court further stated that the Delhi Police prototype, which has been installed in 15 police stations in the South Delhi District, will be evaluated by experts.
“If the Mobile App so developed is found to be fool proof and reliable by the Experts, their report will be of great assistance to the Court before directions are passed,” the Court further added.
With this, the Court called for a comprehensive report in that behalf within six weeks and listed the matter on January 18, 2022.
