The Supreme Court asked the registrar, additional register, and other registration authorities for explanations regarding not listing the case for hearing for a year, though it was ready to be present before the court.
A report dated November 2 and having the concerned registrar’s signature was submitted before the bench today in accordance with a directive issued by the apex court on November 1.
A bench of Chief Justice of India UU Lalit and Justice Bela M Trivedi noted that it is necessary to give clarification in relation to the delay and therefore directed the concerned authority to reply by November 12.
“The report makes a reference to certain acts of some of the officials. Before we take any view in the matter. In fitness of things, the concerned persons must have opportunity to place their explanation before us. We thus direct, the then Learned Registrar , Additional Registrar and official of listing department to file reply by Saturday.“
The Court further ordered them to provide copies of the earlier order, today’s order, and the registrar’s response to the individuals listed in the report to the officials in question.
Further the court said that, “The concerned official shall also have a facility of inspection of the documents appended to the report of the registrars,”
The court directed to present the report of the registrar over the case be placed before sitting bench on Monday.
The Court had directed sent the notice to the registry to explain why the matter was not listed for a year and a half even though it was prepared during the hearing of the plea on November 1.
The Court had also requested information about identical cases that were not listed during this time, as well as any remedial action that may have been taken.
The court will hear the matter on November 7.
