Special Court: Victim to return Compensation in Rape case, Girl turns Hostile

A Special Court in a recent Order directed a minor girl who complained of being raped by two men turned hostile, directed her to return any monetary compensation she received from the State Government, calling it ‘Misappropriation of public money by an unscrupulous person’.

The Special Court acquitted two persons, who were booked for gang Rape, Kidnapping and relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act.

During the Trial, the minor told the Court that she did not know the accused and no such incident took place.

The complaint was filed against two men in 2016 after the minor claimed that she was kidnapped by the two, which made her consume alcohol and then Raped.

The Maharashtra State Government has a compensation scheme called Manodhairya for Victims of Child Abuse, Acid Attacks, etc. 

In the year 2018, changes were made to the scheme that added to recover money given to victims if they turn ‘Deliberately Hostile’.

The recovery was believed to fall under the Maharashtra Land Revenue Code, from Victims or their guardians through attachment of property, seizure or even arrest.

The Court asked the Senior Inspector to take steps to inform the Government regarding the case.
