The High Court of Madhya Pradesh disposed of a Public Interest Litigation which was filed before it with respect to the construction of the boundary wall of Shriram Janki Temple at Bhitarwar in Gwalior.
The Court has directed the petitioner to approach the Collector of Gwalior for redress, which in its opinion will be the competent authority for the same.
The matter was adjudicated upon by a division bench of Justice Sheel Nagu and Justice Deepak Kumar Agarwal.
The Hon’ble judges noted that since the matter contained various disputed questions of fact, it would be appropriate for the petitioner to approach the Collector of Gwalior.
Dismissing the PIL filed before it, the court ordered, “In case, the petitioner makes representation containing all grievances supported by documents before the Collector, Gwalior within 15 days along with copy of this order, the Collector shall consider the same and in case, grievances of the petitioner found to be true then appropriate remedial actions shall be taken as expeditiously as possible,”
The present petition was filed by Chandra Prakash Sen who submitted that despite adequate sanction been granted and funds released for the construction of the Boundary wall of the temple situated at Bhitarwar, the work was yet not completed.
In addition, he said that more than three years had elapsed and the construction work is still held in abeyance.
Certain persons, in his opinion were wrongfully and purposely obstructing the said work.
