The Supreme Court of India on February 17, 2022 agreed to consider hearing the Bail Application of an Accused person named Indrani Mukerjea. The Supreme Court issued a notice in this regard, to the Central Bureau of Investigation (CBI) to give a response pertaining to the Bail Application.
The Supreme Court Bench of Justices L Nageswara Rao and P S Narasimha was hearing the Bail Application of the main Accused person vis-a-vis Indrani Mukerjea in the Murder case of Sheena Bora, who was the daughter of the Accused.
The Counsel for the Petitioner, Senior Advocate Mukul Rohatgi, submitted before the Bench that, “Six and a half years she has been in jail. The trial is not going to end in the next 10 years.” When the Bench questioned the Counsel regarding the number of witnesses left to examine, the Counsel stated that, “185 yet to be examined.”
The Senior Advocate also mentioned that the Trial Court that was conducting the Trial of the Murder case has been vacant since June 2021 and that not witnesses have been examined since last 1.5 years. The Counsel for the Petitioner also submitted that Indrani Mukerjea’s husband Peter Mukerjea, who is a co-accused in the case, is also out on bail.
The Counsel for the Petitioner stated that, “Trial court is vacant without a presiding officer since June 2021. No witness has been examined for the last 1.5 years. My husband is on bail. This lady is not well. She is suffering from cerebral ischemia.”
The Supreme Court Division Bench in light of all the facts, issued a notice to the Central Bureau of Investigation (CBI) in regards with the Petitioner’s Bail Plea and directed the Agency to file a response within 3 weeks of the issuance of the current order.
