A 27-year-old man was sentenced to rigorous imprisonment of 10 years by a special court in Thane, Maharashtra. He had sexually assaulted his neighbour’s 4-year daughter in Kalyan city.
Justice SR Pahade imposed Rs 15000 fine on the convict under the Protection of Children from Sexual Offences (POCSO) Act.
Under section 376(2) (i) of IPC and sec 4 and 6 of the POCSO Act, 2012, Gitesh alias Pintya Baban Bansode was held guilty.
As per the court order under sec 357 A of the CrPC, the government of Maharashtra will have to pay adequate compensation to the victim-girl.
The prosecution stated in the Court that on January 26, 2018, the minor girl was sexually abused by Bansode and he also threatened her to not disclose the incident.
The Court observed in its order:
“Sexual violence, apart from being a dehumanising act, is an unlawful intrusion of the right to privacy and sanctity of a female. It is a serious blow to her supreme honour and offends her self-esteem and dignity; it degrades and humiliates the victim and where the victim is a helpless innocent child, it leaves behind a traumatic experience.”
