The Supreme Court has Ordered the State Government to produce relevant documents at the next hearing on Madhya Pradesh Government’s Policy of rewarding or encouraging public prosecutors who have secured Death Penalty in Trial.
A Bench of Justices UU Lalit, S Raveendran Bhat, and PS Narasimha, investigating how Courts examine the accused and Offences in determining Capital Punishment, particularly in vulnerable Cases, and how Judicial Officers determine whether an Offence warrants the Death Penalty.
While hearing the Criminal Case involving Death Penalty it was brought to the Supreme Court’s attention that Madhya Pradesh has a policy of rewarding Prosecutors who have successfully secured Death Penalty for the accused, the Court asked the Madhya Pradesh Government’s Counsel to produce such Policy.
According to the Supreme Court, the National Legal Services Authority (NALSA) should establish Defense Council or Public Defender Offices in each District of the Country to provide proper Legal Advice to the accused in the same way that Public Prosecutors do in States. The Court stated that we are also considering such a system.
